These Terms of Use govern your access to and use of hmpropertygrp.com (the “Site”), operated by HM Property Group LLC, a Florida limited liability company (“HM Property Group,” “we,” “us,” or “our”). By using the Site or submitting the form on it, you agree to these terms. If you do not agree, please do not use the Site.
The two things that matter most. First, the range shown by our offer estimator is an illustration, not an offer and not an appraisal — a real offer only ever comes in a written purchase agreement. Second, we are a property buyer, not a real estate brokerage, and nothing here is legal, tax, or financial advice.
1. Who we are
HM Property Group LLC is a real estate investment company that purchases residential property for its own account, primarily in Jacksonville and the surrounding Northeast Florida area. We are not a licensed real estate brokerage and we do not represent you in a transaction. We are a principal — the buyer — and our interests as a buyer are our own. You are always free, and encouraged, to consult your own real estate agent, attorney, or accountant before selling.
2. The offer estimator is an estimate, not an offer
The Site includes a tool that displays an estimated range after you enter a property address and answer a few questions. You should understand exactly what that range is:
- It is generated automatically from broad, area-level information and the answers you selected. No one has seen your property when it is displayed.
- It is not an appraisal, not a broker price opinion, not a comparative market analysis, and not a valuation of any kind under Florida law.
- It is not an offer to purchase your property and does not create any obligation for either of us.
- It is not a guarantee that we will offer any amount, or that we will make an offer at all.
An actual offer from us is made only in a written purchase and sale agreement signed by an authorized representative of HM Property Group LLC. Until that document exists and is signed by both parties, no agreement to buy or sell has been formed. Actual offers are commonly different — sometimes materially different — from an estimated range, because they reflect the property's true condition, verified comparable sales, title status, liens, and occupancy.
3. Submitting the form
By submitting the form on the Site, you represent that:
- You are at least 18 years old;
- You are the owner of the property you are asking about, or you are authorized to act on the owner's behalf (for example, as a personal representative of an estate, a trustee, or under a power of attorney);
- The information you provide is accurate to the best of your knowledge;
- The phone number you provide is one you are authorized to receive calls and messages at.
Submitting the form costs nothing and obligates you to nothing. You are under no obligation to accept any offer we make, and there is no fee for receiving one.
4. Consent to be contacted
The consent checkbox on the form is unchecked by default and must be checked by you. Checking it means you agree that HM Property Group LLC may contact you by phone, text message, and email about the property you submitted. Message and data rates may apply. Consent is not a condition of any sale or of receiving an offer. You may opt out at any time by replying STOP to a text message or by emailing [email protected]. 5. No professional advice
Content on the Site — including the comparison table, the FAQ, and anything we say about foreclosure, probate, taxes, or liens — is general information for Jacksonville homeowners, not advice about your situation. It is not legal advice, tax advice, financial advice, or a substitute for a licensed professional. Real estate transactions carry real consequences, and situations involving foreclosure, probate, divorce, or tax liens especially warrant your own attorney. Do not rely on the Site in place of professional counsel.
6. Assignment of contracts
We buy property for our own account. In some transactions, we may assign our rights under a purchase agreement to another buyer, or bring in a partner or funding source to complete the purchase. Where we do so, it will be disclosed in the purchase agreement itself, as Florida law requires. Assignment does not change the price you agreed to.
7. Acceptable use
You agree not to:
- Submit false, misleading, or fraudulent information, or another person's contact information without their permission;
- Submit a property you have no ownership interest in or authority over;
- Use automated tools to scrape, crawl, or overload the Site, or attempt to bypass its rate limits or security controls;
- Attempt to gain unauthorized access to any part of the Site or its underlying systems;
- Use the Site for any unlawful purpose.
We may block access to anyone who does these things.
8. Intellectual property
The Site's text, layout, design, and graphics are owned by HM Property Group LLC or used with permission, and are protected by copyright and other laws. You may view and print pages for your personal, non-commercial use. You may not copy, republish, or use our content for commercial purposes without our written permission. The HM Property Group name and logo are our marks.
9. Testimonials and examples
Any testimonials, purchase examples, closing timelines, or ZIP codes shown on the Site are illustrative of the kinds of transactions we do and are labeled where they are placeholders. They are not a promise or prediction of the price, timeline, or outcome you will receive. Every property and situation is different.
10. Disclaimer of warranties
The Site is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error-free, or that the information on it is complete, current, or accurate. Property data changes constantly and we make no warranty about any figure displayed by the estimator.
11. Limitation of liability
To the fullest extent permitted by law, HM Property Group LLC and its members, managers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, arising out of your use of the Site or your reliance on any estimate shown on it. Our total liability for any claim relating to the Site will not exceed one hundred dollars ($100). Nothing in these terms limits liability that cannot be limited under applicable law, including for fraud.
12. Indemnity
You agree to indemnify and hold harmless HM Property Group LLC from any claim, loss, or expense (including reasonable attorneys' fees) arising out of your misuse of the Site, your violation of these terms, or your submission of information you were not authorized to provide — including a phone number that is not yours.
13. Governing law and disputes
These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute arising out of the Site or these terms will be brought exclusively in the state or federal courts located in Duval County, Florida, and you consent to the jurisdiction of those courts.
14. Changes to these terms
We may update these terms from time to time. Changes take effect when posted, and the “last updated” date above will change. Your continued use of the Site after a change means you accept the revised terms.
15. Severability and entire agreement
If any provision of these terms is held unenforceable, the rest remains in effect. These terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Site. They do not govern any property transaction — that is governed solely by a signed purchase and sale agreement.
